AEV Europe Kft (Hereinafter referred to as "the company") as a data controller hereby informs you as concerned about the purpose of the processing of your personal data, the legal basis and duration of the data handling, the scope of the data being handled, the persons entitled to know the data, the rights of data management and the means of legal remedies.

Please read the brochure carefully to understand how we handle your personal data and understand your privacy.

Our Data Management Practice is based on the General Data Protection Regulation (Hereinafter referred to as "GDPR") 2011 CXII Law on Information Self-Destruction and Freedom of Information. (European Parliament and Council Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directives 95 /

1. Possible goals of data management

-Compliance with legal obligations, including

·         mandatory data management based on accounting and tax laws;

·         mandatory data management based on public procurement legislation;

·         compulsory data management based on data protection legislation (eg data handling verifying receipt of information and agreement to handling).

The fulfillment of a statutory obligation can not be considered as a matter of discretion, and due to lack of data provision a penalty may be imposed on our company so in these cases we can not forbid data management.

- Data management required to perform a contract, maintaining a customer relationship, including

·         data management required for giving offers or requesting a quote;

·         Data handling required for postal, e-mail, fax and telephone contact required to continue a business relationship, including the delivery of the signed contract to you;

 

·         the handling of your data, as a customer for the performance of the contract and the safeguarding of any disputes arising from the contract after termination of the contract;

·         the handling of contact details of you as a customer contact for the performance of the contract and the preservation of any disputes arising from the contract after termination of the contract;

·         Handling of personal data contained in reports, other documents (such as performance statements);

Failure to provide data will not enable signing the contract or may endanger the performance of the contract, taking this into consideration failure to provide the data may result in receding from the contract or it counts as a breach of the cooperation obligation by our partner.

Failure to give permission may result in a deviation in the operation of the website. Granting your consent may be required to include your data in certain company-led databases, so we appreciate  your understanding in this matter.

2. The legal basis for data handling

 

- If your data is handled to comply with a legal obligation (compliance with the legal obligation is the legal basis for data handling), no statement of permission is required.

- If your personal data are required for the purpose of concluding a contract, all your personal data is required that is necessary for your  identification.  In such a case, the contributing statement will be replaced by the initiating of the contract or the supporting behavior with the necessary information provided by Article 6 (1) (b) of the GDPR if you are a contractual party or the representative of the contractor.

- In all other cases, the legal basis for the processing of data is your consent, which you provide by signing a statement of data handling contributing to this information.

3. Duration of data handling

- The data handling begins on the date of recording and communication of your personal data, and lasts for  maximum the time given in your statement of permission, which is the time necessary for the purpose of the data management.

- Data management based on accounting and tax laws (accounts, storage of documents based on them) is 8 years from the start of data management.

- In case of customer relations maximum storage time for data management is 6 years.

- In the cases outside the above cases, the personal data handled by the data subject, the data controller or a third party's legitimate interest, can be managed by the company until the cause of the case is terminated.

5. Rights of persons affected by data handling

Right of access:                                  You are entitled to receive feedback on whether your personal information is being processed and, if so, you have the right to have access to your personal information and data management information. You are required to prove your personal identity to specific personal data, to the recipient of any data transmission and to the source of the data

A copy of the data is free of charge if the requesting party did not submit a copy of the same data field during the current year. In other cases, with the agreement of the management of the company, a reimbursement of HUF 5,000 may be charged to the requesting party. The reimbursement already paid must be refunded if the company determines that the data has been misused or the request for information has led to rectification.

 

Right to rectify:                                  You are entitled to correct inaccurate personal data for you or to complete incomplete personal data. If your identity can not be identified by the circumstances, the management of the company must call you to verify your identity to exercise your right of correction.

Right to delete (forgetting):                Except in the case of statutory compulsory data handling, as well as in the information provided by the company in separate information, you are entitled to have your personal information removed at your request. In cases where the management of a company can demonstrate that the conditions set out in Article 17 (1) of the GDPR are not met or the grounds for exclusion laid down in Article 17 (3) of GDPR are in place, the management of the company may refuse to comply with your request .

                                                           Your personal data processed on your consent will also be canceled if you withdraw your contribution at any time.

The right to restrict data processing:  With the exception of statutory compulsory data handling, you are entitled to restrict personal data handling on your request. In such a case, the data concerned can only be handled for purposes that are not covered by the restriction.

Right to protest:                                 You are entitled to object to your personal data at any time for reasons related to your own situation. In this case, the data controller may not process the personal data unless the data controller proves that the data processing is justified by legitimate reasons of enforceability that prevail over your interests, rights and freedoms or which may be used to present, enforce or protect legal claims related.

If your personal data is handled for direct business, the person is entitled to object at any time to the handling of personal data relating to that purpose, including profiling, if it is related to direct business acquisition.

Right to data storage:                         You are entitled to receive personal information provided by us in a widely used machine-readable format and forward it to another Data Manager. If you require, ask for direct transfer of personal data between data controllers

 

Automated decision making

related rights:

You have the right not to be a subject of automated decision making, including profiling, which would have a legal effect on you, or would have a significant impact on you. The company does not use automated decision making or profiling in the recruitment process, however, if you still experience automated decision making and disagree with its result, please contact us in the data management prospectus, and ask for a review of the decision.

The right to withdraw consent           You have the right to revoke your consent for further processing of your data.

The management of the company will notify you in writing of the request for access, rectification, restriction or deletion or the reasons for its rejection within 30 days of receipt of the request or the call for action to be taken to fulfill the request. The management of the company is obliged to examine the protest within a maximum of 15 days of its submission and to decide on its validity and to inform the person in writing of the decision in writing.

6. Data entry for jobseekers and storage of CVs

If you are applying for an advertised job or for a later job, we inform you that under this Privacy Policy the Company (Data Manager) is responsible for protecting your personal information. Below, we provide information on how we use personal information collected from you and third parties during the bidding process.

a) Types of personal data

When submitting an application to us, the information provided in it can be handled by our company with your consent.

In general, we ask our applicants to provide the following information:

 For example, your name, address, e-mail address, and phone number.

·         Information contained in your resume

For example, your previous career, studies, skills, language skills, and any other    information that you include in your curriculum vitae.

·         Motivation letter

Any information you put into your motivation letter.

·         Proof of good reputation

Depending on the nature of the job, we may ask you to certify that there is no circumstance that would exclude your ability to position.

 

 

 

In addition to the above, we may also request information from third parties depending on the job you are applying for:

·         References

- We can choose to request a reference from people who worked with you before. We are only looking for people whose name and contact you give us. If you are already an employee of the company, you can contact your supervisor and / or your colleagues without having to inform you.

·         Evaluation

- We may be asked to attend, participate, evaluate your skills, personality, or cognitive ability. Prior to participating in a given evaluation , we will provide you with all the additional information needed for the assessment, to which you can make your contribution to it.

·         Internal tenders

- If you are already an employee of the company and you apply for another position within the institution, we can also use data from your staff dossier to complete the information provided on your application.

 

b) The purposes of Data Management

 

The data handler uses your personal information for the following purposes:

- We may use information about you to make sure that you are a properly qualified candidate for the job you are applying for.

·         Settlement of Disputes

- We can use personal information for dispute settlement, investigation of complaints, or legal proceedings.

- Your personal information may also be used to comply with legal requirements or court judgment.

 

c/ Parties with access to your personal data

 

The Data Handler may share your personal information with third parties in the following cases:

 

·         Our employees have access to your personal information for the purpose of performing their duties. In such cases, access is only granted if it is indispensable for the aforementioned purposes and if the employee is bound by a confidentiality obligation;

·         Your personal data may be shared with, for example, law enforcement agencies or other governmental authorities if required by law or court judgment.

e/ Preservation of personal data

We will keep your personal information for a limited period of time (but up to 3 years) and will be deleted if it is no longer necessary for data handling. In most cases, this means that we will keep your information during the application process and delete it as soon as we find the right candidate. There may also be a complaint about discrimination after the closing of the application process, so we may retain your personal information for a further 6 months if it is needed due to a pending legal dispute or if you have consented to it.

6. Remedies

If you have any questions or questions about data management, you can send your application by post or by e-mail to the persons listed in this introductory section (see page 1).

We will send our responses to your address without delay but within 30 days the latest. If you have submitted the application electronically, the information will be provided electronically, unless otherwise requested.

If necessary, taking into account the complexity of the application and the number of applications, this deadline may be extended by two additional months. We will inform you about the extension of the deadline by indicating the causes of the delay within one month of the receipt of the application.

You have the right to complain to the National Data Protection and Information Authority (headquarters: 1125 Budapest, Erzsébet Szilágyi fasor 22 / c., Tel .: +36 (1) 391-1400, e-mail: ugyfelszolgalat@naih.hu, website: www. naih.hu), or because of unlawful data handling, you may opt to refer to your court of domicile of place of residence.

You can initiate a lawsuit to challenge a decision on a protest within 30 days of notification of the decision or the last day of the deadline. Because of your financial damage due to breach of the data management rules, you may claim damages and non-pecuniary damages for damages in court.
